TransCanada Network is exclusively licensed to import Forcefield Protective Headgear™ into Canada. This product meets all requirements under Canadian Consumer Law for sale to Canadians.

Sales Agreement

This agreement represents the complete understanding between the TransCanada Network Services (hereinafter called TransCanada Network) and the customer or customer’s agent (hereinafter called CUSTOMER).

TransCanada Network agrees to keep an updated list of these terms and conditions, including changes, additions or removal of services on-line.

By submitting an on-line order or by sending an email or other request for products and services, CUSTOMER acknowledges having read this agreement and agrees to be bound its terms and conditions.

Services

TransCanada Network will fulfill all orders received from CUSTOMERS promptly in exchange for payment and compliance with the terms and conditions of this agreement. TransCanada Network reserves the right to refuse to sell to any new or existing customers.

TransCanada Network will sell, collect payment for and ship Forcefield Protective Headgear™ according to orders received from this website. TransCanada Network will also answer questions via email and phone and will process returns, exchanges and refunds. TransCanada Network does not assume any responsibility for the use of the product. CUSTOMER acknowledges responsibility for 1) the accuracy and completeness of the information on order forms, 2) agreeing to pay product and shipping fees, as applicable, 3) the use of the product 4) having read and understood all terms and conditions in this document, 5) having read and understood all safety data and warnings on the product and product packaging.

In no event shall TransCanada Network be liable to the CUSTOMER for any damages of any kind arising out of the use or inability to use any Forcefield Protective Headgear™. In the event of TransCanada Network’s’ inability to fulfil product which the CUSTOMER has paid for, TransCanada Network’s maximum liability shall be limited to a refund amount equivalent to the invoiced amount of the product(s) ordered.

CUSTOMER agrees to indemnify and to hold TransCanada Network, and any third party entities related to TransCanada Network services, including Forcefield FF (NA), Ltd. harmless from and against any and all liability, loss, damages, claims, or causes of action, including reasonable legal fees and expenses arising out of or related to the CUSTOMER’s breach of any of the representations and warranties herein, or any other third party claim or related to any use of CUSTOMER’S Forcefield Protective Headgear™.

TransCanada Network gives attention to your privacy and security a priority. You may browse our website without disclosing any personal information. We do not use cookies to store personal data nor do we link non-personal information stored in cookies with personal data. We do not collect information about our visitors from other sources, such as public records or bodies, or private organizations. We do collect the personal data you may volunteer when completing a form to purchase products and this information is used to fulfill your order or contact you to provide you with details about your order. Personal information is not shared with any third party except as required to fill your order or as required by law. You are notified in advance by manager@toddlersafety.ca if the use of your personal information changes and your objection to any changes will be respected.

Our order forms collect both personal data (such as name and contact details) as well as credit card information through a secure server using SSL 3.0, RC4 with 128 bit encryption (High); RSA with 2048 bit exchange. The website name in the browser’s address bar should begin, https. The website name in the browser’s address bar should match the website name on the page’s certificate and should be toddlersafety.ca or www.toddlersafety.ca. These secure servers are owned and managed by TransCanada Network for the sale of Forcefield Protective Headgear™. Please perform this address bar/page certificate check if your browser is reporting an error and update your browser with the latest security detection abilities if a security issue is detected in error. If the check does not result in a match, do not enter any information into the form. Instead email manager@toddlersafety.ca for priority technical assistance or to place your order over the phone. When secure pages are displayed, the information is encrypted before being transmitted over the internet. This encryption makes it difficult for anyone other than TransCanada Network to view the information. Passwords are available (to recall your personal information, not credit card information) online by email via www.toddlersafety.ca. If your email address changes before you are able to obtain a copy of your password, email manager@toddlersafety.ca with the new email address. We have security policies, rules and technical measures to protect the personal data that we have under our control from: unauthorized access, improper use or disclosure, unauthorized modification, unlawful destruction or accidental loss. All our employees and data processors, who have access to, and are associated with the processing of personal data, are obliged to respect the confidentiality of our visitors’ personal data. You may access a copy of your personal information via www.toddlersafety.ca anytime by providing proof of your identity. Under no circumstances will we refuse to allow you access to your information or to change it. If you have any concerns about your security or privacy please contact manager@toddlersafety.ca.

Every effort is made to keep this website up and running smoothly. TransCanada Network cannot, however, be held liable, for the website being temporarily unavailable due to technical issues beyond our control.

Fees

Prices are stated in Canadian Funds. Orders are billed in Canadian Dollars by TransCanada Network.

Every order form lists the price the CUSTOMER agrees to pay for the product(s) selected. Every order is replied to with an email receipt which lists fees for the product, shipping and taxes. Email updates are sent to the CUSTOMER when the product ships and when the CUSTOMER receives the product.

Product payments are due in advance of receiving the product.

There is a $25.00 service charge for each returned cheque. There is a $25.00 service charge for administration of a chargeback. Avoid any unnecessary administrative charges by calling 1-800-747-6882 or emailing manager@toddlersafety.ca for priority service. When payment is submitted by credit card, the CUSTOMER acknowledges that they have the legal right to use the card or are the owner of the card. TransCanada Network reserves the right to request a signature for an online order or to delay shipping for non-payment of an invoice.

Refunds, Exchanges & Returns

TransCanada Network guarantees that the product(s) you order are the product(s) you will receive and will be free of manufacturing defects. Refunds for products returned without an RMA cannot be processed, so please contact us first. If, for any reason, you are not happy with your purchase, please email manager@toddlersafety.ca within 30 days for an RMA (return merchandise authorization number) so we can process your refund or exchange promptly. Defective products must be returned in exactly the same condition they were received. You may also contact us by mail, Forcefield Protective Headgear™ c/o TransCanada Network 2100 Bloor Street West, Suite 6007, Toronto, ON Canada M6S 5A5. Refunds for products returned without an RMA cannot be processed, so please contact us first. Final Sale. Logo customized orders must be proof approved before production and cannot be returned or refunded. Used products will not be accepted for return nor refund for hygiene reasons.

Manufacturers Warranty, Warning, Instructions

Forcefield Protective Headgear™ is designed to be worn by players who participate in sports where protective headgear is not mandatory. Also used by those participating in activities where there is a risk of a fall or a hit to the head. The product is certified to reduce the severity of impacts to the head and does this by significantly absorbing and dissipating the force associated with the impact.

Activities where there is risk of impact force to the head and other parts of the body are dangerous and can result in sub-concussive or concussive brain injuries that may be temporary or permanent.

Although Forcefield Protective Headgear™ can significantly reduce the risk of head injury and impact forces, there is no protective equipment that can eliminate concussions.

This product must be placed right next to the head and remain in place like a sweatband to be effective. Improper placement or modification of this headgear will reduce its effectiveness and will result in an increased risk of a head injury.

If the protective headband is torn, damaged or shows signs of excessive wear, the headband must be replaced.

Hand wash, mild soap, air dry. No machines.

Failure to follow this warning may result in serious and/or permanent injuries.

Except to the extent prohibited by applicable law, all warranties, including, but not limited to, an implied warrant to merchantability or fitness for a particular purpose are disclaimed. In addition, any liability for loss or damage including, but not limited to, personal injury and incidental or consequential damages is specifically disclaimed.

Wholesale, Retail, League and Club Purchases

Distributors agree to all CUSTOMER terms and conditions on this page in addition to the following DISTRIBUTOR terms and conditions. This section contains the terms and conditions that apply to an individual’s or entity’s purchase and resale or re-distribution of Forcefield Protective Headgear™ (the “Inventory”). As used in this Agreement, “our” or “we” means TransCanada Network, the Canadian importer of Forcefield Protective Headgear™ “you or Distributor” means the applicant or retail store owner or authorized buyer or reseller, and “product” means any item offered for sale on toddlersafety.ca. “website” means a World Wide Web site and, depending on the context, refers either to Forcefield Protective Headgear™ or to one or more of our .ca websites including www.forcefieldheadbands.ca, playingsafe.ca, stayingsafe.ca, toddlersafety.ca, curlingsafety.ca, skatesafe.ca and others. “Store” means a physical retail store in Canada.

TransCanada Network grants Distributors a non-exclusive right to purchase inventory for resale or re-distribution in Canada based on the information supplied by the Distributor via the website My Account link. We reserve the right to withhold or revoke distribution rights at our sole discretion or for violation of terms and conditions. Distributors do not need to have a physical store, nor any minimum quantity commitment to receive authorization. Payment terms are prepaid. Only authorized distributors may order inventory for resale or re-distribution. Prices are subject to change. MSRP is recommended. Distributors may set their own price. Distributors may employ or otherwise contract with others to act on the Distributor’s behalf in accordance with the terms of this agreement at the Distributors expense. Distributors are not permitted to make any changes to these terms, the product, product packaging or marketing materials without prior consent. Distributors receive promotional assistance including but not limited to listings on .ca websites. Customized digital and print media for point of sale, handouts, posters and contest flyers are also available. Distributors will keep proprietary information they receive regarding the product, pricing or our business activities confidential.

Discount coupon policy. Distributors are not required to honour discount coupons. Redemption. Participating Distributors remit to Forcefield Coupons, c/o TransCanada Network, 6007 – 2100 Bloor St W, Toronto, ON M6S 5A5. We will reimburse the coupon’s face value plus $0.05. If the coupon is a percentage discount, the coupon’s value will be based on our published MSRP. Distributors can choose to have coupon redemption funds applied to their next order (in which case we will generate a coupon code) or to accept a cheque for the value of the coupons redeemed.

Distributors fully and forever release us from any liability for any damages their customers could suffer owing to the use of the product and acknowledge that the only warranties applicable are those of the manufacturer as noted on product packaging, inside the box and as listed on this page under the heading, manufacturer warranty, warning, instructions. These terms and conditions are agreed to fully, freely and with complete understanding by the Distributor and are agreed to prior to the sale of goods.

Logo customized orders. You must have the legal right to use the logo you submit for customization. Logos are applied at point of manufacture and are subject to customer approval. Minimum quantity 100. Allow 4-6 weeks for delivery.
